Last summer the unions at Harley Davidson in Wisconsin took a monumental vote on the future of jobs in that state. There was some concern that the workers might be voting themselves out of jobs, but in the end, they voted to work with the company and keep 1400 jobs in Wisconsin. However, similar actions have led to the opposite outcome in other manufacturing towns. This session will explore labor management dynamics and how the process and outside influences can and has led to the downfall of a manufacturing institution.

III. Understanding the Dodd-Frank Act

Whistleblower litigation has proliferated, and the stakes have gotten higher with the recent enactment of the Dodd-Frank Act. Whistleblower claims filed under the Sarbanes-Oxley Act have invaded the C-Suite and garner substantial media attention. Dodd-Frank makes those claims more powerful, as it expands SOX's coverage, doubles the statute of limitations and guarantees a right to a jury trial in cases removed to federal court. Moreover, Dodd-Frank creates new rights of action, one of which has a statute of limitations of up to 10 years and provides for double backpay. This presentation will focus on the contours of these laws, discuss key defenses and offer methods of minimizing the risk of these claims.
