Employee Free Choice Act Briefing

The EFCA is likely to be the most comprehensive and significant change in labor relations since the initial passage of the National Labor Relations Act in 1935.  In its current form, the law will:

  • Eliminate secret ballot elections in determining whether employees will be represented by a union;
  • Provide for certification of a union where a majority of employees in a proposed bargaining unit simply sign authorization cards;
  • After the union is certified, the parties have 120 days to negotiate and agree to the terms of a bargaining agreement.  If they cannot agree, an outside arbitrator will determine workers' wages, benefits and other terms and conditions of employment, including pension, subcontracting, layoff and other terms;
  • Significantly increase penalties for employers found to have committed unfair labor practices.  Union penalties remain untouched.

Employers must act now.  Failure to be prepared with a plan that includes communication efforts, an internal audit and other defensive steps with supervisors and employees may lead to unionization of your workforce.
