New Requirements Coming for Illinois Job Ads

The Illinois legislature recently sent HB 3129 to Governor Pritzker for signature. This bill mandates that Illinois employers include a pay scale and disclose benefits in all open job postings, effective January 1, 2025. Those who employ workers in other jurisdictions are already familiar with these kinds of laws, which are proliferating quickly. If signed, this amendment to the Illinois Equal Pay Act will require any employer with 15 or more employees to include pay and benefits in job postings, including bonuses and incentive-based compensation. In addition, it will require employers to post promotion opportunities within 14 days of advertising the job outside their organization. It also mandates that when an employer advertises a job that will be performed in another state, but the employee reports to Illinois, the ad must include these parameters.
HR Source will advise our members when the Governor signs the bill, as we expect he will. We assume the Illinois Department of Labor, which enforces the Illinois Equal Pay Act, will then issue implementing regulations and provide Q&As on the details. Questions have already arisen including what qualifies as a "promotional" opportunity and what benefits must be listed, as many employers have a long list of perks and rewards that could be considered benefits.
