It’s no secret that 2023 has brought a host of changes for Illinois employers with the introduction of new laws, changes to existing laws, and proposed updates to long-standing federal regulations. Despite all these changes, no law has created more uncertainty for employers than the Illinois Paid Leave for All Workers Act, set to go into effect on January 1, 2024.

At its heart, this law requires employers to provide up to 40 hours of paid leave each year that can be used by employees for any reason. Naturally, this raises many questions not only about the leave itself, but also about its administration and its effect on current policies. These questions include:

  • Who does the law apply to?
  • Is anyone exempt from the law?
  • What if I already offer leave to my employees?
  • How do I calculate leave entitlements for part-time employees?
  • Can I require a doctor’s note when an employee wants to use leave?
  • Can I refuse to grant leave if multiple employees want to use it at once?
