With Illinois having passed a new amendment to the Illinois Human Rights Act at the end of March 2021, severely restricting the use of criminal background checks, employers have to be more careful than ever. Among other things, this new law requires employers to provide notice to the candidate regarding the conviction, clearly articulate why the conviction makes the candidate unfit for the job and provide the candidate an opportunity to contest the rescission of the job offer.

In this session, originally presented on April 16, 2021, Sonal Shah and Jim Griffin will discuss the various federal and state laws that apply to the background check process and how employers can conduct a background check in a way that meets their needs and complies with all applicable laws.
