Main Content Area New Law Alert on Conducting Criminal Background Checks April 16, 2021 (59 Minutes) With Illinois having passed a new amendment to the Illinois Human Rights Act at the end of March 2021, severely restricting the use of criminal background checks, employers have to be more careful than ever. Among other things, this new law requires employers to provide notice to the candidate regarding the conviction, clearly articulate why the conviction makes the candidate unfit for the job and provide the candidate an opportunity to contest the rescission of the job offer.
