In 2021, Illinois Governor J.B. Pritzker signed an amendment to the Illinois Equal Pay Act that requires private-sector employers with 100 or more employees to report employee pay data to the state and certify that the employer does not discriminate against employees in pay. While initially these reports were to be due in 2024, the state changed that and reports could be due as soon as March 2022.

With Illinois having passed a new amendment to the Illinois Human Rights Act at the end of March 2021, severely restricting the use of criminal background checks, employers have to be more careful than ever. Among other things, this new law requires employers to provide notice to the candidate regarding the conviction, clearly articulate why the conviction makes the candidate unfit for the job and provide the candidate an opportunity to contest the rescission of the job offer.
