EEO-1 Reporting Returns to Spring Timeline

Historically the EEO-1 report was filed by covered employers with a target due date in September. But during the pandemic, EEO-1 filing timelines became slightly erratic. In 2021, covered employers filed two years of required data due to pandemic disruption. Last year, the EEO-1 reporting portal opened in late October with a due date of December 5, but it continued to accept reports until January. So, if you feel like you just filed your EEO-1 Report, you’re not wrong.

The Equal Employment Opportunity Commission (EEOC), which is tasked with collecting the data from the EEO-1, has announced that the 2023 report portal will open towards the end of April with a deadline of early June. 

It’s also published the 2023 EEO-1 Component 1 Instruction Booklet and the 2023 EEO-1 data file upload specifications

Component 1 data covers workforce demographic data. Component 2 data salary information is not required for this filing this year. The EEOC requires electronic submission of EEO-1 Component 1 report(s) through a web-based data collection portal referred to as the EEO-1 Component 1 Online Filing System (OFS). The OFS is accessible on the EEOC's dedicated EEO-1 Component 1 website at www.eeocdata.org/eeo1

Covered employers should be aware that the EEOC will only accept EEO-1 Component 1 reports submitted and certified through the OFS. It will not accept reports submitted via paper or through other non-OFS electronic means such as email or USB port. The EEOC’s help desk is slated to open on April 30th to assist covered report filers. 

This reporting exempts public employers and private, non-government contractor employers with less than 100 employees. Government contractors and subcontractors who have 50 or more employees and $50,000 and more in government contracts and subcontracts must report.
